1. About Us 

  1. Mindology Limited (“we”, “us” and “the Company”), is a company registered in the Hong Kong Special Administrative Region (“Hong Kong”) with company number 73884215 and our registered office is at Unit 2A, 17/F, Glenealy Tower, 1 Glenealy, Central, Hong Kong. 

2. The Agreement 

  1. The following are the terms and conditions (the “ Terms and Conditions”) which regulate your use of our: online platform (the “Platform”), counselling services (“Counselling Services”), and any information made available. The Platform may be accessible via the websites: mindology.hk and mindology.com.hk. 

  2. By accessing or using the Platform, you are accepting the Terms and Conditions. You should read the Terms and Conditions carefully before using the Platform. If you do not agree to all of the terms Terms and Conditions, do not access the Platform. 

3. Counselling Services 

  1. The Platform may be used to match you with a Counsellor (“Counsellor”) who will provide Counselling Services including but not limited to, counselling, coaching, psychoeducation, and corporate services. 

  2. The Counsellors are independent contractors. Our role is limited to providing the Platform, enabling you to access Counselling Services. The Counselling Services are the responsibility of the Counsellor who provides them. If you feel the Counselling Services provided by the Counsellor do not fit your needs, you may contact support@mindology.hk for a referral to another Counsellor. 

  3. All Counsellors providing Counselling Services on the Platform hold professional degrees and active membership with a professional mental health board. All Counsellors have completed relevant education, training, and field experience. 

  4. While we hope the Counselling Services are beneficial to you, you acknowledge that they may not be suitable for every situation or every individual. In particular, individuals with imminent life-threatening risks to themselves or other people, or individuals with severe psychiatric disorders should seek in-person services from other providers instead of Counselling Services provided through Mindology. 

  5. If you are thinking about suicide or if you are considering hurting yourself or others or if you have any medical emergency, do not use the Platform. You must call 999 immediately if you are located in Hong Kong, or your local emergency service provider. The Platform is not intended for emergency services, or for the provision of clinical diagnosis. 

4. Privacy Policy 

  1. The Company may collect information for the purposes of contacting you and processing your appointment. This information may include but is not limited to your first and last name, email address & phone number. 

  2. Information you provide in the intake form and during counselling will be kept confidential by the Counsellor. The Company does not have access to the 1 information you provide through the intake form and during counselling. It is the responsibility of the Counsellor to manage and protect the said information. 

5. Using the Platform 

  1. You hereby confirm and agree that all the information you provided in or through the Platform, and the information that you will provide in or through the Platform in the future, is accurate, true, current, and complete. 

6. Using the Platform as an adult 

  1. You hereby confirm that you are above the legal age of eighteen (18) and legally able to consent to receive Counselling Services, and that you are legally able to enter into a contract. 

7. Using the Platform as a Minor 

  1. You hereby confirm that you as a minor, under the legal age of eighteen (18), will provide the name and contact information of a parent or legal guardian that is legally able to authorize consent for you to receive Counselling Services, and are legally able to enter into a contract. 

  2. Any information that you share in therapy is confidential between you and the Counsellor. This information will not be shared unless you give consent to disclose certain information to your parent or legal guardian. In some situations, it is required by law or professional ethics that information discussed in therapy must be disclosed for your wellbeing. 

8. Disclaimer and Limitation of Liability 

  1. The Company does not provide the Counselling Services itself. Counsellors are independent of the Company and they use the Platform to schedule appointments and communicate with you. Any information or treatment received from the Counsellor comes from the Counsellor alone, and not from the Company. 

  2. The Company may facilitate your selection of, communications with, and other interactions with the Counsellor. The Counsellor-Client relationship is between you and the Counsellor. 

  3. You hereby release us and agree to hold us harmless from any and all causes of action and claims of any sort resulting from the Counselling Services or the Platform, including (without limitation) any act, omission, opinion, advice, information, and/or service of any Counsellor and/or any other content or information accessible through the Platform. 

  4. You understand and agree that we shall not be liable to you or to any third party for any indirect, incidental, consequential, punitive, or exemplary damages. 

  5. If the applicable law does not allow the limitation of liability as set forth above, the limitation will be deemed modified solely to the extent necessary to comply with the applicable law. 

  6. This section (limitation of liability) shall survive the termination or expiration of the Terms and Conditions. 

9. Termination or interference with the Platform 

  1. We may modify or suspend your access to the Platform, at any time with or without notice to you. You agree and acknowledge that we will not be liable for any of the aforementioned actions or for any losses caused by any of the aforementioned actions. 

  2. We will take reasonable efforts to ensure the Platform’s reliability and accessibility, we cannot guarantee that access to the Platform will be uninterrupted or that it will be accessible or error-free unremittingly. 

10. Counselling Services Fee 

  1. You agree to pay all fees as published on the Platform. Subject to subsequent changes, payment is made on a per-session basis upon the confirmation of your appointment. 

  2. Cancellation of a session within 24 hours of the scheduled appointment time will not be refunded. 

11. General 

  1. Terms and Termination. The Terms and Conditions shall commence upon schedule confirmation of your first counselling session on the Platform. The Terms and Conditions may be terminated by us, in accordance with Clause 9. 

  2. Severance. Each clause of the Terms and Conditions operates separately. If any court or legal authority decides that any of them is unlawful or unenforceable, the remaining paragraphs will remain in full force and effect. 

  3. Revisions. We may revise the Terms and Conditions by updating amendments on the Platform. Unless otherwise specified by us, all amendments shall be effective upon posting. You are encouraged to review the Terms and Conditions regularly. By using the Platform after the amendments become effective, you agree to be bound by the amendments to the Terms and Conditions. 

  4. Limitation of liability. To clear any doubt, all clauses regarding limitations of liability and indemnification shall survive the termination or expiration of the Terms and Conditions. 

  5. Governing law and jurisdiction. The Terms and Conditions are governed by the laws of Hong Kong.
